TERMS AND CONDITIONS

This web site (“Site”) and related services are provided by The University of Arizona Health Network, Inc.’s Affiliates, University Medical Center Corporation and University Physicians Healthcare (“Health Care Providers”) to its patients subject to compliance with the terms and conditions set forth below. Please read the following information carefully. Your continued use of this Site will indicate your agreement to be bound by the terms and conditions set forth below. If you do not agree to be bound by these terms and conditions, promptly exit this Site.

  1. Privacy

    Your privacy is of the utmost importance to us. Health Care Providers will use your confidential medical information in order to provide you health care services. Health Care Providers will, at all times, maintain your confidential medical information in strict confidence and will not disclose any information regarding you to any unaffiliated third party unless you authorize that person to receive your information or the information is permitted to be disclosed by law. Please review Health Care Providers Notice of Privacy Practices for a thorough description of how we gather, use and protect your confidential medical information. All messages sent and received within MyChart that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records and are subject to disclosures as permitted by law.

  2. MyChart Features

    1. Electronic Messaging

      MyChart should never be used for emergencies. The anticipated turnaround time for response to electronic messages is two business day(s). Therefore, for all emergencies, please contact your physician’s office by phone, go to an emergency room, or dial 911.

      If your provider is out of the office or unavailable, messages sent via MyChart may be routed to other authorized caregivers within Health Care Providers in order to facilitate a timely response to your request.

      We are only able to respond to such communications based on the information provided by you. If there is insufficient information provided, we will be unable to provide accurate and reliable services.

    2. Secure Communications

      All communications between you and Health Care Providers using MyChart occur over a secure connection. You will receive Internet e-mail messages notifying you that new information is available in your MyChart account. These e-mail messages, however, will not contain any confidential medical information. All of the confidential medical information available to you in MyChart is protected and securely maintained by Health Care Providers.

    3. Access Code

      When you initially enroll in MyChart, you will be provided with an access code. The access code you receive will give you the opportunity to create a personal login name (called “MyChart ID”) and a password. Once this access code has been used it will no longer be valid. It is extremely important that you keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access your confidential medical information, including diagnoses and other information that you might consider sensitive and private. That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your login and password, and to change your password if you feel that your security has been compromised. You may change your password at any time.

    4. E-mail Privacy

      As a user of MyChart you should be aware that you will be notified via e-mail when there is new medical information to be viewed on MyChart. This means that any person with access to your email will be able to see this notification. This could include your spouse, employer, or anyone else that can access your email account. Although no private medical information will be sent, the notification that new medical information is available by accessing MyChart may be information you would not want others to know. Thus, you should take this into account when providing an e-mail address.

      Please know that if you send us an e-mail communication, it may be shared with Health Care Providers’ staff that assists the physician in providing your medical care. Your confidential medical information on MyChart will be accessible only to appropriate clinical staff.

    5. Security and Confidentiality

      Health Care Providers afford the same degree of confidentiality to medical information stored on MyChart as is given to medical information stored by us in any other medium. We are committed to protecting the confidentiality of your medical information. We limit our employees’ access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We shall identify the records released and note the time and date of access each time you access MyChart. We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use. As a MyChart user, you also have a role in maintaining the security of your medical information, and you can fulfill your role by: 1) changing your password on a regular basis, including any time you believe that your MyChart ID or password have been compromised, and 2) keeping your login ID and password confidential.

  3. Minor Access

    A parent or legal guardian of a minor child up to the child’s 12th birthday may request proxy access to his/her child’s account by completing the Proxy Access portion of the Consent Form and submitting it to your physician’s office. Such access will only be granted to parties with parental rights or legal guardianship over the child’s account and only to the extent that the party requesting proxy access can demonstrate the legal right to account holder's medical information. Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section of this Terms and Conditions statement. Under State and Federal law, there are certain types of medical information that the parent or guardian of a minor patient age 12 or older may not view without consent of the minor patient

  4. Proxy Access

    You may grant another person over 18 years of age Proxy Access to your account. Only one person will be granted proxy access to your account. An account will be activated for your proxy and you. If you decide you would like to terminate the proxy relationship or the proxy’s legal relationship with you changes, you must inform Health Care Providers immediately by calling 694-8888 or sending written notice to your physician’s office. Health Care Provider also reserves the right to revoke proxy access at any time for any reason. In deciding to grant proxy access to another person, you should keep in mind that anyone with access to your login name and password will be able to access your confidential medical information, including diagnoses and other information that you might consider sensitive and private.

  5. Information Does Not Constitute Medical Advice

    This Site is intended for informational purposes only. Health Care Providers assumes no responsibility for how you use the information you obtain from this Site. You should consult with a physician or other health care provider regarding your own condition and how this Site content may or may not apply to you.

    You may be accessing your own medical information via the MyChart application and may wish to communicate with one of your health care providers about that or related information. If you have an emergency, please call 911 or go to a hospital emergency room. If your matter is not urgent, please contact your physician’s office. Please do not use the email communication options provided to you by MyChart. Neither MyChart nor any other application available through this Site is a substitute for appropriate and timely contact with your physician. This Site is not a substitute for consultation with your physician. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.

  6. Termination of Access

    The Health Care Providers may restrict or terminate access to MyChart at any time. If access is restricted for planned maintenance of the MyChart system, every effort will be made to communicate downtime to all users in advance. However, there may be reasons to restrict access to MyChart without advance notice. If your use of MyChart violates these Terms and Conditions, the Health Care Providers reserve the right to permanently terminate access to MyChart.

    You agree to defend, indemnify, and hold Health Care Providers and their employers, employees, and agents harmless from and against any claims, actions or demands, liabilities and settlements, including without limitation reasonable legal fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.

  7. Restrictions on Use and Ownership

    All pages within this Site and any material made available for download are the property of Health Care Providers and/or its subsidiaries and affiliates. The content on the Site is provided for Health Care Providers and its patients only. Nothing on this Site should be construed as granting any license or right to use any trademark, service mark, or logo displayed on this Site without the express permission of Health Care Providers or the third party that may own the trademark, service mark, or logo.

  8. Accuracy and Integrity of Information

    Although Health Care Providers attempts to ensure the integrity of the Site, it makes no guarantees whatsoever as to the correctness or accuracy of the Site. It is possible that the Site could include typographical errors, inaccuracies or other errors. In the event that an inaccuracy arises, please inform your physician’s office so that it can be corrected. Information contained on the Site may be changed or updated without notice.

  9. Links to Other Sites

    Health Care Providers makes no representations whatsoever about any other web site that you may access through this site or any entity that may post its advertisements on this Site. When you access a non-Health Care Providers site, please be advised that it is independent from Health Care Providers, and that Health Care Providers has no control over the content on that web site. Health Care Providers does not endorse or accept any responsibility for the content or use of any other linked site. If you decide to access any third party sites linked to this Site, you do so entirely at your own risk. Never ignore professional medical advice in seeking treatment because of something you have read on a linked site.

  10. Liability

    The use of the Site and its content is at your own risk. When using the Site, information will be transmitted over a medium that may be beyond the control and jurisdiction of Health Care Providers and its vendors. Accordingly, Health Care Providers assume no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Site.

    The Site and the content are provided on an "as is" basis. Health Care Providers, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE.

    In no event shall Health Care Providers be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the Site, whether based on warranty, contract, tort, or any other legal theory, and whether or not Health Care Providers or any third parties mentioned on the Site are advised of the possibility of such damages. Health Care Providers or any third parties mentioned on the Site shall be liable only to the extent of actual damages incurred by you, not to exceed U.S. $1,000.00, on any claim. Health Care Providers or any third parties mentioned on the Site are not liable for any personal injury, including death, caused by your use or misuse of the Site. Any claims arising in connection with your use of the Site must be brought within one hundred eighty (180) days of the date of the event giving rise to such action occurred. Remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.

  11. Entire Agreement

    Except as expressly provided in the Health Care Providers Notice of Privacy Practices, these Terms and Conditions constitute the entire agreement between you and Health Care Providers with respect to the use of the Site. These Terms and Conditions are governed by the laws of the State of Arizona.
